Cancellation Conditions & Cruise Policy

Information contained herein is a contract. The transportation of the guests and personals on Swan River

Charters vessels is provided solely by the Operator and is goverened by the Terms and Condition printed below.

Swan River Charters reserves the right to cancel any charters without consultation or compensation under the following circumstances:

• Passengers behave in an anti-­‐social or threatening manner to any passenger, Crew Member or Member of public

• Passengers behave in a manner deemed by any crew member to a danger to themselves or other persons

• Any member of a crew observes underage drinking or excessive alcohol consumption

• Crew members observe intended passengers in an apparent state of intoxication

• Passengers behave in a manner that may put the vessel, people, on board equipment or facilities at the  risk of damage

• Crew members observe intended passengers causing damage to any facilities at any public or private  berthing prior to boarding

• Any Passengers jump off a vessel at any point of the charter including prior to departure.

Cancelled or Postponed Charters

Swan River Charters reserves the right to withdraw and/or cancel a charter or to make changes to the itinery, or in the judgement of the vessel owner or operator if the conditions warrant it. In the event of charters of the vessels, Truces, Lockouts, riots or stoppage of labour from whatever cause or for any other reason whatsoever, The owner or operator of the vessel identified in this brochure may, at anytime, cancel, advance or postpone any scheduled tour and may, but is not obligated to, substitute another vessel or itinery and shall not be liable for any loss whatsoever to guests by reason of any such cancellation advancement or postponement.

Cancellation, Fees and Changes Policy

For any booking cancelled, whether under deposit, partially paid, or paid in full are considered cancellations and penalties will apply as noted below. All cancellations must be in writing. For all written cancellations received prior to departure up to the scheduled time of departure the following will apply.

Once a booking has been made or paid in full, all changes are subject to a 25% charge per change. See prior section under Cancellation Policy for details on situations, which are classified, as cancellations rather than changes.

For all ticketed events, any purchased tickets are non-refundable.

5 Months Notice 25% Refund
3 Months Notice 50% Refund
1 Month Notice NO Refund

Bond Refunds

When making a booking we collect a bond. The bond is then held until the charter has been completed. Charges can include damages to vessel, theft on the boat or any major cleaning like food in carpets, Body paint or confetti as it doesn't come off the carpet very easy.

In the event where the Skipper or staff cancel the charter early due to extreme misconduct and have to terminate the cruise there is no bond refund

Additionally guests accept the need to disembark quietly and quickly and not to cause offence or disturbance to residents whether the jetties be in the vacinity of any business, carpark or residentual area of disembarking. Any damage to any other venue or vessel on arrival or departure will be taken out of your Bond.

To have the bond refunded faster please email or call Swan River Charters with your bank details so we can forward the details to the accounts department straight away.

EFT refunds can take up to 7 business days. The organiser has 30 days to claim the Bond before the bond becomes invalid.

Minors & Children

Due to our Duty of Care, Swan River Charters does not allow minors to consume ANY alcohol. We request that on all cruises with guests under the age of 18, must be accompanied by a parent or legal guardian. We reserve the right to limit the number of minors under the age of 18 years on board. If any staff see any minor consume alcohol, we have the right to turn the boat around and there will be no charter refund.

Liability, Damage and Loss

Swan river Charters accepts no liability or responsibility for any injuries, damages, loss, delay or irregularity which may be occasioned either by reason or defect, through the acts or defaults of any company or person, or in carrying out the arrangements of the charter, as a result of any cause beyond our control. Guests specifically release Swan River Charters from any & all claims for loss or damage to personal effects, property or from personal injuries or death, delay arising out of the acts, omissions or negligence of any independent contractors.

Refusal Of Passenger

Swan River Charters shall not be required to refund any amount paid by any participant who must leave the charter prematurely for any reason. Nor shall Swan River Charters or the owners or operators of the vessels identified in this brochure are responsible for the return transportation or other expenses incurred by such charter participant.
